Terms and conditions

These Terms and Conditions (hereinafter, the «Terms») govern access to and use of the Ziblo platform (hereinafter, the «Service»), a management system for restaurants, bars, pizzerias, and similar businesses. By using the Service, the user declares that they have read, understood, and fully accepted these Terms.

1. Data Controller and Contacts

2. Definitions

  • Service: the Ziblo platform, accessible via web and its related features.
  • User: any natural or legal person accessing or using the Service.
  • Restaurant Owner: the User who uses the Service to manage their restaurant business.
  • Reseller: the party authorized by the Data Controller to promote and/or distribute the Service to third parties.
  • Account: the reserved area associated with the User’s credentials.
  • Paid Modules: optional additional features that can be activated for a fee.

3. Service Scope

Ziblo is a management system that allows, among other things, the management of menus, orders, reservations, and cash registers. The Service is offered in its basic version free of charge. Some additional features may be available as Paid Modules, whose activation is optional and subject to the fees indicated at the time of subscription.

The Data Controller reserves the right to modify, supplement, or suspend any features of the Service at any time, providing reasonable notice when reasonably possible.

4. Registration and Account

Using the Service may require the creation of an Account. The User undertakes to provide truthful, complete, and up-to-date data and is solely responsible for the confidentiality of their credentials and any activity carried out through their Account.

The User must promptly notify the Data Controller of any unauthorized use of their Account. The Data Controller is not liable for damages arising from the User’s failure to safeguard their credentials.

5. User Obligations

The User agrees to use the Service in compliance with the law and these Terms. In particular, the User must not:

  • use the Service for illegal or unauthorized purposes;
  • violate the rights of third parties, including intellectual property and privacy;
  • compromise the security, integrity, or operation of the Service;
  • attempt to access areas or data not intended for the User;
  • insert false, offensive, or unlawful content.

6. Paid Modules and Fees

Activating Paid Modules entails acceptance of the related fees, clearly indicated before subscription. Unless otherwise specified, prices are inclusive or exclusive of VAT as specified at the time of purchase. The billing, duration, renewal, and any termination conditions for Paid Modules are indicated during activation and form an integral part of these Terms.

7. Resellers

Relationships with Resellers are governed by specific agreements between the Data Controller and the individual Reseller. The Reseller is not authorized to make any statements or provide any additional warranties on behalf of the Data Controller beyond those set out in these Terms and the official Service documentation.

8. User Content

The User remains the owner of the data and content entered into the Service (e.g., menus, customer records, reservations). The User grants the Data Controller the right to process such content strictly as necessary to provide the Service. The User guarantees that they have all necessary rights to the content entered and is solely responsible for it.

9. Intellectual Property

The Service, software, trademarks, logos, and all related content are owned by the Data Controller or their respective rights holders and are protected by applicable laws. Nothing in these Terms transfers any intellectual property rights in the Service to the User, which is granted solely for use as provided herein.

10. Personal Data Processing

Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable laws. Processing methods are described in the Privacy Policy, which the User is invited to consult. If the Data Controller processes personal data on behalf of the User, the parties may enter into a specific data processing agreement (DPA).

11. Service Availability

The Data Controller strives to ensure the best possible continuity and availability of the Service but does not guarantee uninterrupted or error-free operation. The Service may be temporarily suspended for maintenance, updates, or causes beyond the Data Controller’s control. The Service is provided «as is» and «as available».

12. Limitation of Liability

To the extent permitted by law, the Data Controller is not liable for indirect, consequential damages, data loss, lost profits, or business interruptions resulting from the use or non-use of the Service. The Data Controller’s liability remains in cases where it cannot be excluded or limited by law (e.g., willful misconduct or gross negligence). The User is responsible for making their own backups of their data unless otherwise agreed.

13. Suspension and Termination

The Data Controller may suspend or terminate the provision of the Service, in whole or in part, for Users who violate these Terms or the law. The User may cease using the Service at any time. In the event of termination, the provisions regarding the retention and possible return or deletion of data set out in the Privacy Policy apply.

14. Changes to the Terms

The Data Controller reserves the right to modify these Terms at any time. Changes will be made available on this page with an indication of the update date. Continued use of the Service after the publication of changes constitutes acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms are governed by Italian law. Any disputes relating to their interpretation and enforcement shall be subject to the exclusive jurisdiction of the courts of [city], subject to any mandatory consumer protection provisions.

16. Final Provisions

The invalidity or unenforceability of any provision of these Terms does not affect the validity of the remaining provisions. The Data Controller’s tolerance of the User’s non-compliant behavior does not constitute a waiver of rights under these Terms.
